Judge dismisses prosecutors' appeals in investigation

The judge investigating the Attorney General of the State in the Supreme Court, Ángel Hurtado, issued an order this Wednesday dismissing the appeals filed by Álvaro García Ortiz and prosecutor Pilar Rodríguez. Both were summoned to testify as investigated parties for an alleged offense of revealing secrets. The accused claimed that contraindications that could explain their prosecution were omitted, such as the fact that the leaked email containing private data was sent to a generic account of the Economic Crimes Prosecutor's Office.

The judge considered that, despite that argument, there are sufficient elements to attribute to them the leaking of personal information of a citizen in a media outlet, which for him constitutes the essence of the offense of revealing secrets. In his opinion, the authorized disclosure of a subsequent email has no relation to the leak of the prior confidential content.

In another ruling, the judge decided to archive the case against the third accused, Diego Villafañe Díez, deputy prosecutor of the Technical Secretariat of the Attorney General's Office. After carrying out various investigative actions, the judge considered that the initial indications that led to his prosecution had weakened. Furthermore, it was pointed out that the possibility of unrelated individuals being responsible for the investigated leak is not supported.

The judge emphasized the interest shown by the Attorney General in the email from February 2, 2024, and the immediate leak of its content in a media outlet. It was concluded that there were sufficient indications to presume that the Attorney General leaked the information. His involvement in the preparation of an informative note was also mentioned. On the other hand, the comparison between the leak of the email and the authorized disclosure of a subsequent email by a collaborator of the president was rejected.

In summary, the judge rejected the appeals filed, upheld the prosecution of the two accused for revealing secrets, and archived the case against the third accused, considering that the indications against him had weakened.
