Justice Rejects Halting Euthanasia for 25-Year-Old Woman

Spain's Supreme Court has rejected an ultra-Catholic organization's request to halt the euthanasia of 25-year-old Noelia, who suffers from paraplegia. The court ruled that her right to a dignified death had already been legally established.

Justice Rejects Halting Euthanasia for 25-Year-Old Woman

Justice rejects stopping euthanasia for a 25-year-old young woman. Furthermore, the magistrate argues that Noelia is not a party to the criminal proceedings opened following the complaint by Christian Lawyers, so any decision that might affect her fundamental rights could put her «in a situation of defenselessness». Regarding the young woman's capacity to decide on her dignified death, the magistrate recalls that «this issue has been resolved both administratively and judicially, for which reason there is no need for psychological and/or psychiatric treatment». Justice has once again rejected an interim measure to halt the euthanasia of Noelia, 25, just hours before it was to be carried out, by dismissing the precautionary measures «at the last minute» proposed by the ultra-Catholic foundation Christian Lawyers. The entity, which for a year and a half has represented Noelia's father in his legal battle to prevent her assisted death, has requested precautionary measures for the third time before the investigation court number 20 in Barcelona, which is investigating the complaint it filed against two members of the Generalitat commission that authorized the dignified death of the young woman, who suffers from paraplegia. In its writ, Christian Lawyers asks that Noelia's euthanasia, scheduled for 6:00 PM this afternoon at the social health center where she resides, be stopped and that she be provided with psychological and psychiatric treatment until a final ruling is issued in relation to the investigation into the alleged malfeasance complaint that the court is handling. Investigation in a premature stage. The investigation of the complaint is still in a premature stage: the judge agreed to admit it to proceedings and requested documentation on the legal process by which the Generalitat granted euthanasia to Noelia to determine if there are indications of a crime by the members of the commission. The magistrate herself points out in her order that admitted the complaint to give «legal coverage» to the request for documentation on the process, which «could not be done in any other way». According to the criteria of the Prosecutor's Office, the judge rejects the precautionary measures on the grounds that she «lacks the power» to adopt them, given that the competent courts have already issued «the appropriate decisions».
