The Superior Court of Justice of Catalonia (TSJC) has rejected the appeals filed by the Generalitat regarding 12 procedures related to the maintenance of 25% of classes in Spanish in Catalan classrooms. In eight cases, the TSJC has not admitted the Govern’s appeals, while in the other four it has dismissed the appeals filed by the regional government.
According to recent reports, the TSJC has ordered the maintenance of the 25% of classes in Spanish in 12 classrooms, which goes against the Generalitat's intentions to apply Decree Law 6/2022, approved by the Parliament, which regulates the use of official languages in Catalonia and prohibits the application of percentages in this regard.
In its appeal, the Generalitat requested the TSJC for a "unifying interpretation" of the provisions of Law 8/2022 on the use and learning of official languages in non-university education in Catalonia, arguing the lack of a unified jurisprudence on this matter. However, the TSJC has justified the rejection of these appeals by considering that the need for cassation intervention in the matter has not been sufficiently substantiated.
The TSJC has imposed costs of 2,000 euros on the Generalitat for each unfavorable ruling. Despite the attempts of the Govern of Salvador Illa to prevent the implementation of bilingualism in Catalan classrooms, the current situation has not changed, and the Generalitat has the option of appealing to the Constitutional Court to resolve this controversy.
